Federal Judge Orders Freedom of Abrego Garcia from Immigration Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.
"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was held in federal detention.
In her decision, the judge pointed out that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
